4 NOTICE OF VIOLATION Commonwealth Edison Company Docket Nos. 50-373; 50-374 LaSalle Units 1 and 2 License Nos. NPF-11; NPF-18 During an NRC inspection completed on July 16,1998, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.1.1.1 states, in part, that each high radiation area in which the intensity of radiation is greater than 100 millirem /hr but less than 1000 mil l; rem /hr shall be barricaded and conspicuously posted as a high radiation area and entrance thereto shall be controlled by requiring issuance of a radiation work permit (RWP). Any individual or group of individuals permitted to enter such areas shall be provided with or accompanied by one or more of the following: (1) A radiation monitoring device which continuously indicates the radiation dose in the area; (2) A radiation monitoring device which continuously integrates the radiation dose rate in the area and alarms when a preset integrated dose is received. Entry into such areas with this monitoring device may be made after the dose rate level in the area has been established and personnel have been made knowledgeable of them; or (3) A health physics qualified individual, i.e., qualified in radiation protection procedures, with a radiation dose rate monitoring device, who is responsible for providing positive control over the activities within the area and shall perform periodic radiation surveillance at the frequency specified by the health physicist in the RWP.

Contrary to the above, on May 26,1998, two construction laborers were permitted to enter (and entered) the Unit 2 A reactor water cleanup heat exchanger room, a high radiation area having dose rates exceeding 100 millirem /hr but less than 1000 millirem /hr, without satisfying the provisions of Technical Specification 6.1.1.1. Specifically, the construction laborers were not provided with a radiation monitoring device which continuously indicated the radiation dose in the area and were not accompanied by a health physics qualified individual. Although the laborers were wearing a radiation monitoring device which continuously integrated the radiation dose rate in the area and alarmed when a preset integrated dose was received (i.e..' electronic dosimetry), the dose rate levels in the area were not established prior to the entry and were not known by the laborers.

This is a Severity Level IV violation (Supplement IV).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance will be achieved is already adequately addressed on the docket in Inspection Report Nos. 50-373/98018(DRS); 50-374/98018(DRS). However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C.

20555 with a copy to the Regional Administrator, Region Ill, and a copy to the NRC Resident inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).
