Good morning,

Based on the email below, my understanding is that you will be withdrawing the application submitted in 2021 for the 435-B (Docket No. 71-9355), but you still want the changes requested in your 2021 submittal for revising the certificate of compliance for the Model No.

435-B. This is different from just withdrawing the application as we had previously discussed.

I saw the changes that you were requesting in the 2021 submittal and they seem to be substantial. Since you still want to incorporate the changes in the 2021, please add to the letter withdrawing (cancelling) the application submitted in 2021 that you are also requesting to consolidate the application submitted in 2021 and the application submitted in 2023. This will ensure that all the changes that you want are incorporated in the CoC.

When I receive the letter mentioned in this email, the staff will start the review based on the request on the letter that you will be sending. Note that, as previously mentioned, the staff is not working on this request because it was not clear if you wanted to consolidate both applications.

I will appreciate that you send the letter as soon as possible. This will ensure that the scope of the review is well defined.

Norma,

Im still awaiting a cancellation signature form our certifying official but here is a copy of the cancellation of the subject request (Also attached). A copy of the unsigned cancellation request is also provided. I will get the letter into ADAMS e-submittal as soon as I can get it signed. I believe we can move forward with the current request. If we get to the point where the CoC is ready for distribution may we have an opportunity to review it to possibly deconflict some content issues which was the focus of the 2021 request?
