. 1 ENCLOSURE I NOTICE OF VIOLATION I

Duke Power Company Docket Nos. 50-413, 50-414 Catawba 1 and 2 License Nos. NPF-35 and NPF-52 During the Nuclear Regulatory Commission (NRC) inspection conducted on i November 27, 1988, through February 4, 1989, violations of NRC requirements were  !

identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989), the violations are listed below:

A. 10 CFR 50.59 requires the licensee to perform a written safety evaluation which provides the bases for the determination that a change in the facility as described in the safety analysis report does not involve an unreviewed safety question.

Contrary to the above, on December 18, 1988, the licensee determined that 1RN-244, Control Room Area Chiller Condenser "A" Automatic Flow Control Valve, was not functioning to automatically control flow, chose not to declare the associated equipment inoperable, and failed to perform a written safety evaluation to provide the bases for the determination that operating 1RN-244 fully open with the actuator removed, a change in the facility as described in section 9.2.1.2.3 of the Final Safety Analysis Report, did not involve an unreviewed safety question.

This is a Severity Level IV violation (Supplement I).

B. Technical Specification 6.8.1 requires that written procedures shall be established, implemented, and maintained covering the activities referenced j in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978. '

Station Directive 3.11.1, Housekeeping and Cleanliness Levels in Safety l

and Non Safety Related Areas, requires Level IV cleanliness in the Reactor Building and that Level IV cleanliness be obtained by removal of all dirt ,

and debris from the area.  !

~ Contrary to the above, administrative measures in effect were inadequate to ensure acceptable levels of cleanliness in the vicinity of the Containment Air Return Fan (VX) pit drain in that on January 26, 1989, the Unit 1 pit drain was observed by NRC inspectors to be partially obstructed with debris. An obstructed drain would render both VX fans inoperable in that following a loss of coolant accident (LOCA), containment spray flow l into the pit would eventually flood out the fans.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby I required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector within thirty (30) days of the date of the letter transmitting this Notice, i This reply should be clearly marked as a " Reply to a Notice of Violation" and i

should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
