ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-413, 50-414 Catawba Nuclear Station License Nos. NPF-35 and NPF-52 Units 1 and 2 During the Nuclear Regulatory Commission (NRC) inspection conducted on May 28, 1989 - July 1,1989, violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, 53 Fed. Reg. 40019 )

(October 13,1988), the violations are set forth below:

A. 10 CFR 20.203(2) requires that each entrance or access point to a high  !

radiatior. arer be maintained locked except during periods when access to j the area is required, with positive control over each entry. {

l Technical Specification 6.11 requires that procedures for personnel  !

radiation protection be prepared consistent with the requirements of  !

l 10 CFR 20 and shall be approved, maintained and adhered to for all 4 l

operations involving personnel radiation exposure.

l Plant Procedure HP/0/B/1000/25, Catawba Nuclear Station High Radiation j Area Access, requires each entrance to a high radiation area to be locked j to prevent unauthorized entry. The area shall remain locked except during ~

periods of access by personnel. .

Contrary to the above, on June 14, 1989, the entrance to Room 316. "B" Recycle Holdup Tank Room, a posted high radiation area, was not maintained  ;

locked during a period when personnel access was not in progress, in that .'

at approximately 2:45 p.m., the door was discovered by the resident inspector to be in an unlock 2d condition without positive entry control  ;

This is a Severity level IV Violation (Supplement IV).

B. Technical Specification 6.8.1 requires that written procedures shall be established, implemented, and maintained covering the activities referenced in Appendix A of Regulatory Guide 1.33, Revision ~2, February .

1978. Implicit in this is the stipulation that the procedure be adequate '

for the task being perfornked.

Plant Procedure OP/0/A/6200/21, Operating Procedure for the Post Accident  :

Liquid Sampling System, requires valve 2KCD5, Component Cooling (KC)

Isolation Essential Return Header 1A, to be locked closed when the sampling system is not in use.

Contrary to the above, PT/?/A/4208/08, Post Accident Liquid Sampling System Periodic Test, was inadequate to ensure valve 2KCD5 was locked closed af ter use on June 2,1989 in that valve 2KCD5 was discovered open l and unlocked on June 14, 1989 by NRC inspectors.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washir.gton, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector within thirty (30) days of the date of the letter transmitting this Notice. This reply should be clearly marked as a

" Reply to a Notice of Violation" and should include for each violation:

(1) admission or denial of the violation, (2) the reason for the violation j if admitted, (3) the corrective steps which have been taken and the ,

results achieved, (4) the corrective steps which will be taken to avoid . '

further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to l extending the response time. If an adequate reply is not received within f the time specified in this Notice, an order may be issued to show cause {

why the license should not be modified, suspended, nr revoked or why such {

other action as may be proper should not be taken. l I
