Gentlemen:

SUBJECT: NOTICE OF VIOLATION

-(INSPECTIONREPORTNOS. 50-413/88-38AND50-414/88-38)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

W.'T. Orders and M. S. Lesser on November 27, 1988 to February 4,1989.

The

inspection included a review of activities authorized for your Catawba

facility.

At the conclusion of the inspection, the findings were discussed

with those members of your. staff identified in the enclosed inspection report.

Areas examined during the inspection are identified .in the report.

Within.

these areas, the inspection consisted of selective examinations of' procedures

and representative records, interviews with personnel, and observation of

activities in progress.

The inspection findings indicate that certain activities appeared to' violate

NRC requirements.

The violations, references to pertinent requirements, and

elements to be included in your response are presented in the enclosed Notice

of Violation.

One additional violation described in the enclosed Inspection Report is under

Consideration for escalated enforcement action.

Accordingly, it is not

included in the enclosed Notice and no response to this violation is required

at this time.

However, please be advised that the number and characterization

of violations described in the enclosed Inspection Report may change as a

result of further NRC review.

An Enforcement Conference to discuss this

. violation has- been scheduled for March 9,1989.

You will be advised by

separate correspondence of the results of our deliberations on this matter.

Your attention 1s invited to the unresolved items identified in the inspection

report. These matters will be pursued during future inspections.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and its enclosures

will be placed in the NRC Public Document Room.
