l NOTICE OF VIOLATION Duke Energy Corporation Docket No. 50-413, 414 l

Catawba Nuclear Station License No. NPF-35, 52 During an NRC inspection conducted from July 5 - August 15, 1998, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation is listed below:

Technical Specification 6.8.1.a requires that written procedures be established, implemented and maintained covering the activities recommended in Appendix A of Regulatory Guide (RG) 1.33. Revision 2.

As referenced in Section 8 of RG 1.33, this includes surveillance test procedures.

Contrary to the above, prior to April 15, 1998, the licensee failed to establish adequate surveillance procedures to ensure that, during the conduct of PT/1(2)/A/4200/059. Nuclear Service Water System to Auxiliary Feedwater (CA) System Suction Piping Flush, Revision 31 (32), affected auxiliary feedwater system pumps would be declared inoperable and logged into the Technical Specification Action Item Log. As a result, the licensee failed to recognize that the conduct of this test rendered affected auxiliary feedwater system equipment (a motor-driven CA pump and the turbine-driven CA pump) inoperable for the duration of the test.

This is a Severity Level IV Violation (Supplement I).

The NRC has concluded that information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in Inspection Report No. 50-413/414/98-08.

However, you are required to submit a written statement or explanation pursuant to 10 CFR 2,201 if the description therein does not accurately reflect your corrective actions or your position.

In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector at the Catawba-facility, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

If you contest this enforcement action, you should also provide a copy of your response to the Director. Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001.
