ENCLOSURE NOTICE OF VIOLATION Duke Power Company Docket No. 50-413 Catawba Nuclear Station License No. NPF-35 Unit 1 EA 90-118 During the: Nuclear Regulatory Commission (NRC) inspection conducted on June 11-19, 1990, a violation of NRC requirements was identified. In

Technical Specification 6.8.1 requires that writt' aved procedures shall. be established. implemented, and maintaint ' applicable activities recommended in Appendix A of Regulator Revision 2, February 1978.

Appendix A of Regulatory Guide 1.33, Revision 2, February 1978, recommer' procedures for surveillance tests. Test proce/ PT/1/A/4200/57, FW ak ND Check Valve Full Stroke Test, requires th; talve IND-33 be closed .

prior to opening valves IND-36B, 37A, 32A, and 4NI-178B. 1 Contrary to the above, on June 11, 1990, during the performance of test procedure PT/1/A/4200/57, FW and ND Check Valve Full Stroke Test, the Unit I control room operator failed to verify that manual valve IND-33 had been closed as required by the procedure before proceeding with subsequent procedure steps. This resulted in an inadvertent diversion of 5,000 gallons of reactor coolant to the Refueling Water Storage Tank, violations of the pressurizer cooldown -and heatup rate limitations -an inadvertent operating Mode . change, and a momentary loss of residual heat removal capability.

.This is a Severity Level IV Violation and applies to Unit 1 only.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby  :

required to submit a written statement or explanation to the Nuclear Regulatory Commission ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional' Administrator, Region II, and a copy to the NRC Resident Inspector, Catawba, within thirty (30) days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice- of Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, ~

consideration will be given to extending the response time.
