_ NOTICE OF VIOLATION

' Duke Power Company. Docket Nos. 50-413 an'd 50-414 1 Catawba Units 1 and-2 License Nos. NPF-35 and-NPF-52 I T During.the Nuclear Regulatory Commission-(NRC) inspection conducted on June' 24, through August 2,1990, violations- of NRC requirements.were identified. In accordance withithe " General-Statement of_ Policy _and Procedures for NRC m

Enforcement Actions," 10'CFR Part 2. Appendix C L(1990),- the violations; are listed below:

A. 10 CFR' 50.59 requires that a licensee receive NRC approval prior toi making a change to their facility as it is described in the FSAR_, or i performing a test not oescribed in:the FSAR, if t theitest or change involves, an unreviewed safety question.-

' Technical Specification 3.6.1.8 requires that two independent Annulus Ventilation (VE) Systems be ' operable when the unit-is operated in . Modes-F '1,_2, 3 or 4. With one. system inoperable, the inoperable system must be.

restored to operable: status.within 7 days or-the unit must be placed.in at least HOT STANDBY within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />.. With both systems-inoperable, the unit must be placed in the-action' requirement of, Technical Specification 3.0.3.

Contrary to the'above, on July 18, 1990, the. licensee made a modification P -to:the Catawba Unit 1 facility as described .in the. safety; analysis report, s

in that the upper annulus door, part of' the. annulus (secondary -

containment): ventilation boundary, was secured in.the open position.

-This modification did-not receive a 50.59 evaluation to determine the-h existence of an unreviewed' safety question. The open door-rendered both trains of.VE inoperable in that the: system .could not. perform its intended safety function of producing and_ maintaining a negative' pressure in:the. ,

- annulus nor minimizing the' release of radioisotopes from the annulus 1" > following a LOCA.

si B.- 10 CFR 50, Appendix B,; Criterion-XVI as implemented by Duke Power Company Topical Report- Quality Assurance Program (Duke-1-A, Amendment 6) Section 17.2.16, reqtiires that measures be established to assure that the cause of significant conditions adverse to quality be determined and corrective action taken to preclude repetition.

Contrary to the above, on July 10, 1990, the licensee's corrective actions were inadequate when faulty valve actuators were identified in the Unit 1 train B Diesel Generator Starting Air System. This resulted

' Contrary to the above, on March 2, 1990,'while performing procedure ilP/0/A/3890/02~to make heater temperature Jetpoint adjustments for Train A j w: .of the, Unit 2 VE System, Instrumentation and Electrical (IAE) technicians -

  • .. failed to follow the procedure in that they did not. document the lifting
