s ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket No, 50-414 Catawba 2 License No. NPF-52 During the Nuclear Regulatory Commission (NRC) insnection conducted on March 26, 1988 through April 25, 1988, violations of NRC requirements were identified. In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions", 10 CFR Part 2, Appendix C (1988), the violations are listed below:

A.

Technical Specification 8.1.1 requires in part that two separate and independent diesel generators be operable.

With a diesel generator inoperable, restore the diesel generator to operable status within 72 heurs or be in at least Hot Standby within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />.

Contrary to the above, Diesel Generator 2B was inoperable

December 17, 1987 to December 29, 1987 in that emergency bus 2ETB was incapable of itamediately deenergizing and load shedding upon a degraded voltage condition in conjunction with an Engineered Safeguards Features Actuation and the licensee failed to place the plant in Hot Standby until December 24, 1987 when the unit was shutdown for refueling.

This is a Severity Level IV Violation (Supplement I).

B.

Technical Specification 3.3.3.6 requires that Pressurizer Safety Valve Position Indicator (1/ valve) be operable in Modes 1 through 3, with an indicator inoperable, the indicator must be restored to operable status within 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br /> or the unit be in at least Hot Standby (Mode 3) within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> and in Hot Shutdown (Mode 4) within the following 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />.

Contrary to the above, on February 24, 1988, the licensee failed to place the unit in Hot Standby and subsequently in Hot Shutdown when the Pressurizer Safety Valve Position Indicator had been inoperable for greater than 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />.

This is a Severity Level IV Violation (Supplement I).

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATIN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector within thirty (30) days of the date of the letter transmitting ;nis Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further vio.lations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
