o ENCLOSURE 1 NOTICE OF VIOLATION Ouke Power Company Docket Nos. 50-413, 50-414 Catawba 1 and 2 License Nos. NPF-35 and NPF-52 Ouring the Nuclear Regulatory Commission (NRC) inspection conducted on June 26, 1988 through July 25, 1988, a violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC

Enforcement Actions", 10 CFR Part 2, Appendix C (1988), the violation is listed

! below:

l l Technical Specification 3.3.3.6 requires that the accident monitoring I

channels as shown in Table 3.3-10 be operable. The Action Statement specifies that with the number of operable accident monitoring instru-mentation channels less than the Total Number of channels shown in Table 3.3-10, restore the inoperable channel (s) to operable status witnin 7 days, or be in at least hot standby within the next 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br /> and in hot shutdown within the following 6 hours6.944444e-5 days <br />0.00167 hours <br />9.920635e-6 weeks <br />2.283e-6 months <br />. Table 3.3-10 shows the Total Number of channels required for PORV Block Valve Position Indicator as 2/ valve on Unit I and prior to May 27, 1988 as 2/ valve on Unit 2.

Contrary to the above, the licensee failed to maintain two operable channels per valve for PDRV Block Valve Position Indicators from initial licensing until May 20, 1988 and failed to comply with the Action Statement.

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a written statement or explanation to the Nuclear Regulatory l

Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to  !

l the Regional Administrator, Region II, and a copy to the NRC Resident Inspector within thirty (30) days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the violation, l

(2) the reason for the violation if admitted (3) the corrective steps which have been takan and the results achieved, (4) the corrective steps which will l be taken to avoid further violations, and (5) the date when full compliance  !'
