Dear Adm!nistrative Judges:

This is to inform you that the parties met in Boston on Monday, September 71, to discuss the matters raised in the telephone conference call of September 17, 1987. The parties engaged in extensive discussions, and believe that they have made a good faith effort to agree upon the subject '

matter categories and order of presentation of evidence at the forthcoming hearings. Accordingly, the parties have requested that I report the results of these conversations as follows.

1. The parties have largely adopted the subject matter categories proposed by the Licensing Board, with certain limited exceptions, as set forth in the Attachment hereto.1/ Under each of these subject matter headings, the parties have grouped the various pieces of testimony that were prefiled l on September 11, 1987, in making these designations, the parties attempted i to assign each piece of testimony to the subject matter heading to which it ,

most closely related, recognizing that many of the issues are interrelated and 1 that some pieces of testimony are not readily divisible into separate 1/ Two of the Licensing Board's categories, " Transportation Availabliity" and " Emergency Support Services" are now grouped together in one  !

category; and the Boara's " Miscellaneous" category has been renamed

" Letters of Agreement".

y categories, in particular, some interveners were concerned that the testimony related to population and human behavior issues, which appears under the heading of " Evacuation Time Estimates", is also relevant to such issues as " Shelter", " Response Personnel Adequacy", and " Reception Centers". Accordingly, the parties agreed that the inclusion of a piece of testimony in any particular subject matter category should not preclude consideration of that testimony in connection with other subject matter categories to which it may relate.

2. The parties agreed that the issues should be heard in the order set forth in the Attachment, except to the extent necessary to accommodate any problems of. witness availability that may arise in the course of the hearings.

In this regard, it should be noted that the parties only discussed the grouping of testimony into categories and the order in which the categories will be presented; no attempt was made to determine the order in which the various pieces of testimony will be presented within each particular category.

3. The interveners plan to designate lead interveners for each subject matter category, and will advise the Board of these designations as soon as possible; such designation will be provided, in any event, no later than the commencement of hearings on October 5,1987.
