Dear Members of the Appeal Board:
In our response of Februarv 5,1987 to the Joint Appeal of the Licensing Board's Order of January 7,
- 1987, the Staff took the position that interlocutory review was not warranted at this time because the Licensing Board's Order would not deprive the parties of an opportunity to respond fully to Applicants' waiver petition.
However, the Staff noted at pages 13-14 of our response that the Licensing Board had issued an Order on February 3rd that might cause the Staff to change our position.
The Staff filed a Motion for Clarification of the Licensing Board's February 3rd Order on February 10th; the Board responded with a Memorandum and Order dated February 12th.
In its latest Order, the Licensing Board recognized that the Staff (and presurcably, the other parties) would require substantial additional time to complete its review of Applicants' petition, agreed that the Commission should be provided with a sufficient record to reach a well-founded conclusion on whether or not to grant the petition, and indicated that the parties would be given until February 27, 1987 to " supplement and possibly complete their initial responses."
(Memorandum and Order of February 12, 1987, at 2-3).
In light of the Board's most recent Memorandum and Order, the Staff continues to believe that the parties will have an opportunity (beyond February 27th) to respond fully to lhe waiver petition. Accordingly, the Licensing Doard's Order of February 3rd does not affect the position taken by the Staff in its February 5th pleading before this Appeal Board.
