NRC STAFF MOTION FOR LEAVE TO FILE OUT OF TIME On February 27, 1988, Elizabeth Dolly Weinhold filed a appeal of the Licensing Board's decision in Public Service Company of New Hampshire (Seabrook Station, Units 1 and 2), LBP-89-03, 29 NRC (January 30, 1989).
That decision denied her petition to admit certain late-filed contentions in its entirety.
LBP-89-03, slip op. at 19.
Pursuant to 10 C.F.R. 6 2.714a(a), the Staff's response to Ms. Weinhold's appeal was due on March 14, 1989.
The Staff wrongly considered the time allowed by 10 C.F.R. $ 2.730(c) in computing its response date as March 20, 1989.
The Staff regrets this failure and requests leave to file the accompanying "NRC Staff Response In Opposition To Ms. Dolly Weinhold's Appeal Of LBP-89-03," out of time.
The undersigned attempted to obtain Ms.
Weinhold's consent to this request but she was unavailble.
To minimize any inconvenience to the parties and Appeal Board, this filing is being sent via express mail to Ms. Weinhold and counsel for applicants.
