Dear Members of the Appeal Board:

By Memorandum and Order dated July 30, 1987, the NRC Staff was ordered to Initiate discussions with the other parties interected in the adequacy of the East Kingston sirens to give emergency alert notifications, with a view to seeing if an agreement could be reached on the conduct of another test of the sirens this coming winter. The NRC Staff was further to report on the outcome of those discussions by September 1,1987.

The Staff has contacted counsel for each of the parties designated by the Appeal Board as interested in this matter. It obtained from the Appilcant a copy of its procedures applicable to the testing of the East Kingston sirens, transmitted those procedures to counsel for the Seacoast Anti-Pollution League (SAPL) and the Commonwealth of Massachusetts, and asked counsel for those ]j parties if they would agree to the conduct of the test prescribed by the 1 Appeal Board under the Applicant's procedures. The Staff further asked those parties to suggest a winter date for the conduct of the test of the sirens. Counsel for the Commonwealth of Massachusetts advised Staff counsel that, as SAPL was principally interested in this matter, he would abide by any agreement SAPL made. concerning the testing of these sirens. As a result of a follow-up teleplone call from Staff counsel to counsel for SAPL last week , the Staff was informed that the procedures had never been received. Another set of the procedures was sent to counse' for SAPL by i express delivery, and the Staff is awaiting a response on whether counsel for l SAPL agrees to the conduct of the test of the East Kingston sirens under i those procedures and a suggested date for the conduct of the test.
