DE C01MENTS - TES PHASE II PROGRAM PLAN - DIABLO CANY0fl IDVP-We have concluded that the Phase II program plan is basically consistent with the requirements of the Commission order and the NRR letter of November 19, 1981. There are several areas in which we feel the program plan should be supplemented to reflect recent events; principally the final evolution of the PGE/Bechtel corrective action plan and the IDVP comitment to monitor that corrective action plan. -

With regard to the division of activities into Phase I and Phase II, we believe that the relationship between the work accomplished in each phase and the requirements for restoration of the low power license has been obscured by the extent of the corrective action plan found necessary by PG&E to date. The Phase I and Phase II designations still provide a useful partition of the IDVP efforts and should be maintained for that purpose.

Restoration of the license, however, should await sufficient completion of both Phase I' and Phase II activities (as well as any other activities that subsequently become necessary) so that the nature and extent of all plant modifications are defined.

Decisions as to modifi-cations that must be completed before granting authorization for fuel loading and sequentially before operation up to 5% power and beyond can then be made in knowledge of the full spectrum of construction activities and possibilities for interactions that could occur during the' required modifications.

Subphase Dates The subphase dates as provided in the Phase II program, plan are accept '

able for the purpose of selecting samples. A requirement that the PGE/

Bechtel corrective action plan'(ITP) fully addresses the actions taken by PGE since the disclosure of the " diagram error" in 1981 should be-included in the documents reflecting staff concurrence in the ITP. TES 1

Responsibilities for Review (Conflict of Interest)

Selection of Samples and Analysis Approach The first paragraph of section 3.3 on' page 18 of the plan should be clarified to better define the acceptance criteria for the qualit9 assurance program and implementation. This paragraph states that evaluation shall be " relative e

to the criteria of 10 CFR 50 Appendix B as they are understood at the i

present time, but not including the contents of implementing standards approved subsequent to performance of the work as requirements applicable to the work." The Phase I plan (section 2.2 on page 6) simply indicated l

any subsequent upgrades adopted by PG&E, but would clearly not include all current interpretatic1s of staff requirements.

Verification Program (IDVP) for Diablo Canyon Nuclear Pcyer Plant.

The NRC staff, Pacific Gas and Electric Company, and participants in the IDVP had met in Bethesda, Maryland on' Tuesday,. October 19, 1982 to discuss the same subject.

Copies of the transcripts of these two meetings and SECY-82-414, transmitting the staff recommendation presently before the Commission, are hereby provided for your information~.

Parties have been notified by the Office of,

the General Counsel of the opportunity to address the co= mission in a meeting tentatively scheduled for Wednesday, November 10, 1982 in response to the staff briefing.

We will inform you of the details regarding the upcoming meeuing as soon as they are finalized.
