l APPENDIX A NOTICE OF VIOLATION PECO Energy Docket No. 50-353 Limerick Generating Station License No. NPF-85 Unit 2 1

During an NRC inspection conducted on September 27, 1994 through October 31, 1994, a violation of NRC requirements was identified. In accordance with the

" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

10 CFR 50.54(q) requires in part that a licensee authorized to possess and operate a nuclear power reactor shall follow and maintain in effect emergency plans which meet the standards in 10 CFR 50.47(b).

10 CFR 50.47(b) requires in part that the onsite and offsite emergency response plans for nuclear power reactors must meet the following standards: a standard emergency classification and action level scheme, the bases of which include facility system and effluent parameters.

ERP-101, Classification of Emergencies, written to comply the 10 CFR 50.47(b), requires in part that the Emergency Director classify an event based on selected categories and most severe EAL (Emergency Action Level).

Contrary to the above, on September 12, 1994, with Unit 2 at 100% power, the Shift Manager, acting as the Emergency Director, did not classify an event based on selected categories and most severe EAL. An Unusual Event (UE) declaration was not made after the Shift Manager was informed that a dose assessment, performed by the shift health physics technician in response to an alarm received on the south vent stack noble gas monitor, indichted that the projected offsite dose was 8.98 E-2 mrem /hr TPARD (Total Protective Action Recommendation Dose), in excess of the EAL for a UE of 5.7 E-2 mrem /hr TPARD.

This is a Severity Level IV violation (Supplement VIII).

Pursuant to the provisions of 10 CFR 2.201, PECO Energy is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Documnnt Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice).

This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that ,

will be taken to avoid further violations, and (4) the date when full j compliance will be achieved. Your response may reference or include previous i docketed correspondence, if the correspondence adequately addresses the required response. 2 specified in this Notice, an order or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the response time.
