ENCLOSURE 1 NOTICE OF VIOLATION PECO Enerav Docket Nos. 50 353 Limerick Generatina Station License Nos.NPF 85 Unit R During an NRC inspection conducted on May 28 through July 21,1997, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG 1600, the violation is listed below:

10 CFR 50.73(a)(2)(i)(B) requires that a Licensee Event Report (LER) be submitted ,

within 30 days after the discovery of an event, including any operation or condition prohibited by the plant's Technical Specification (TS). 2 Contrary to the above, as of June 5,1997, the NRC identified an instance where PECO Energy did not submit an LER within 30 days after discovery of an event, which occurred on March 16,1993, for a condition prohibited by the plant's TS.

Specifically, a compensatory chemistry grab sample for hydrogen in the Unit 2 offgas system was obtained after the four hour time interval required by the plants' TS had expired.

This is a Severity Level IV violation (Supplement 1).

The NRC has concluded that the information regarding the reason for the violation, the corrective actions taken and planned to correct the violation and prevent recurrence and the date when full compliance was achieved is already adequately addressed on the docket in this inspection report. However, you are required to submit a written statement or explanation pursuant to 10 CFR 2.201 if the description therein does not accurately reflect your corrective actions or your position. In that case, or if you choose to respond, clearly mark your response as a " Reply to a Notice of Violation," and send it to the U.S. Nucler.r Regulatory Commision, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and a copy to the NRC Resident inspector at the facility that is the subiect of this Notice, within 30 days of the date of the letter transmitting this N.) tic 6 of Violation (Notice).
