EN 98-049 OFFICE OF ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION j Licensee: PECO Nuclear (EA 98-141)

Limerick, Units 1 & 2 Docket Nos. 50-352; 50-353 Subiect: PROPOSED IMPOSITION OF civil PENALTY - $55,000 This is to inform the Commisslon that a Notice of Violation and Proposed imposition of Civil Penalty in the amount of $55,000 will be issued on or about July 7,1998, to PECO Nuclear.

This action is based on two violations related to the failure to take appropriate corrective action to address conditions adverse to quality at the facility. In the first violation the failure to take adequate corrective actions resulted in a containment isolation valvc being incperable for a considerable timeframe and in the second violation the failure to determine the root cause and take adequate corrective actions resulted in a residual heat removal pump minimum flow valve being found mispositioned on four occasions, which could have led to pump damage had the pump been called upon to operate. The two violations are classified in the aggregate at Severity Level 111. Because this was not the first escalated enforcement action I

within the past two years, the staff considered whether credit was warranted for identification and corrective action. Credit was not warranted for identification, because the NRC identified i the conditions adverse to quality. Credit was warranted for corrective actions because PECO's corrective actions were considered prompt and comprehensive at the time of the enforcement conference.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice July 7,1998 Telephone Notification of Licensee July 7,1998 The Commonwealth of Pennsylvania will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC l evaluation of the response, the civil penalties may be remitted, mitigated, or imposed by Order.
