ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-369 and 50-370 McGuire Units 1 and 2 License Ncs. NPF-9 and NPF-17 The following violation was identified during an inspection conducted on February 3-7, 1986. The Severity Level was assi NRC Enforcement Policy (10 CFR Part 2, Appendix C)gned in,accordance with the Technical Specification (TS) 4.0.5 specifies that ASME Section XI testing of ASME Code Class valves shall be performed as Surveillance Requirements.

For ASME Code Class Safety Injection Valves NI 185A and NI 184A (in both Units), ASME Section XI requires that their operation be observed at least once every 2 years to verify that their remote position indicators accurately reflect their operation. TSs 4.0.3 and 4.0.4 specify that failure to perform Surveillance Requirements within the required time interval is a failure to meet Operability Requirements for a Limiting Condition of Oper-ation and that the Operational Mode shall not be entered until the Surveil-lance Requirements have been performed.

Contrary to the above, the licensee had not performed the ASME Section XI (Surveillance Requirements) position indicator testing on valves NI 185A and NI 1848 and the Operational Mode had been entered.

This is a Severity Level IV violation (Supplement I).

Pursuant to 10 CFR 2.201, you are required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged violations; (2) the reasons for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
