RE: APPLICANT'S RESPONSE M CBG'S RESPONSE 'IO APPLICANT'S (BJECTIONS TO RELEASE OF A CERTAIN PHOTOGRAPH

Dear Administrative Judges:

By pleading dated June 4,1982, Applicant filed a response to CBG's May 18 response to Applicant's hy 3 objections to release of c, photograph taken by CBG on an inspection some months earlier.

Such a response appears to CBG to constitute an impermissible ..

answer under 10 CFR H 2.730(c), which prohibits responses to responses without leave of the presiding officer. No such leave was requested by nor granted to Applicant as to its June 4 argument.

Should the Board decide not to disregard Applicant's response as at variance with the rules of practice, CBG respectfully requests leave to respond to those portions of Applicant's June 4 pleading which CBG views as not accurately representing the matters addressed therein.
