MEMORANDlM Jj

'ws, )

'IO:

J. Bay, G.

ods, J. Hobson (c/o W. Cormier), and C. Woodhead FROM:

h. Hirsch RE: Correcting Editorial Error in Proposed Board Order DATE: October 23, 1985 In its Memorandum and Order of October 16, 1985, responding to the stipulation and proposed Board Order, the Board pointed out an editorial oversight in the proposed Order.

Whereas the stipulation mandates that no portion of the UCLA reactor may be re-used in another reactor at UCLA, the proposed Eoard says merely the components parts may. not be used for another reactor.

'Ihe words "at UCLA" appear to ha ve been inadvertently left out of the proposed Orcer.

To correct the editorial oversight, the words "at UCLA" should be added at the end of item 6 on page 2 of the proposed Order.

I have so inserted those words on the attached replacement page, four copies of which are enclosed.

Please approve the correction and initial the replacement pages.

This correction is being transmitted in the same fashion and order as the stipulation: Hirsch to Bay to Woods to Cormier and Hobson to Woodhead to Board (copies of final signed versions back to University and CBG. As the Board has requested the response to its Memorandum and Order by next week, one day turn around time at each step is needed, as it was with the stipulation.

In conversation between CBG and Staff as to the Board Memorandum and Order, it was proposed, (1) that CBG send out this correction of the clerical / editorial error and (2) that since the other Board questions are primarily addressed to Staff, that Staff draft a response and consult with CDG and UCLA about the text of that response with the understanding that if the Staff response is acceptable, CBG and UCLA would not submit responses of their own.

As of this writing, Ms. Woodhead had not yet oeen able to reach Mr. Cormi7r tc confirm this procedure, so if UCLA has any problem with it, please promptly so notify the other parties.

Correction of Editorial Error in Proposed Board Order

'Ihe words "at UCIA" were inadvertently left off the end of item 6 on page 2 of the proposed Board Order, although they were intended to be included and were in fact included in a related provision elsewhere in the stipulation to which the proposed Order was appended.

She parties approve correction of this error and affirm that this correction does not ccristitute a change to the provisions of the proposed Order within the meaning of Section 17 of this Agreement.
