Pursuant to the Freedom of Information Act, as amended, I hereby request: SECY-84-ll6 and Memo SECY to H.H.E. Plaine dated 6/13/84 related to UCLA Reactor License Renewal Proceeding and '

Staff Request to Initiate Rulemaking on the Interpretation of

, 10 CFR 73.40(a). These items are identified on page 3 of Enclosure 0 of the Weekly Information Report to the Commissioners, for the

_ week ending June 15, 1984, attached.

If these documeats are to-be included in response to a previous F0IA request of CBG's, please ionore this request. If not, please provide the requested documents. We note that the matter of SECY 83-500 (the Staff proposal addressed in these documents) is no longer predecisional, as the Commission has acted upon the matter.

We request fee waiver. CBG is a party to the UCLA proceeding, and is preparing a report on the issue of sabotage requirements for research reactors for the use of the Commission, Congress, and the press. The material requested is necessar. for both matters.

Chairman Palladino stated that following receipt of the- staf f 's resource summary, the Commission would determine how to proceed on this type of program.

> The Commission approved a proposed order that declines the

! NRC staff's' request to initiate a rulemaking~ proceeding to I modify two decisions by the Ato ic Safety and Licensing Board presiding over the UCLA research reactor proceeding.

j The ASLB decisions held that 10 CFR 73.40 (a) requires UCLA to take some measures to protect the reactor from potential sabotage. The extent of the measures is the issue that was before the Board.

l Commissioners Roberts, Asselstine and Bernthal approved the (

i- proposed order as attached to SECY-84-ll6. Chairman Palladino disapproved; his separate views are attached to the order.

Commissioner Gilinsky did not participate.
