Dear Mr. Allen:

By letter dated August 27,2010, FirstEnergy Nuclear Operating Company (FENOC) submitted an application pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 51 and 10 CFR Part 54, to renew Operating License NPF-003 for the Davis-Besse Nuclear Power Station, Unit 1 (Davis-Besse), for review by the U.S. Nuclear Regulatory Commission (NRC or the staff).

Enclosed is the NRC staffs revised safety review schedule for the Davis-Besse license renewal application (LRA). The staff has revised the review schedule due to the large number of open items (Ols) that could not be resolved within the original schedule. Reasons for the large number of open items include:

  • delay in responses to requests for additional information (RAls)
  • large number of follow-up RAls

Additionally, resolution of the Class 1 valves 01 will not occur until information on the fatigue analysis of the Class 1 valves is provided and reviewed by the staff. Your staff agreed to provide information on the fatigue analysis for the Class 1 valves on May 31, 2012, and this will delay the completion of the Safety Evaluation Report.

To support the revised schedule milestones, your responses to the staffs RAls must be complete and provided in a timely manner. After receiving the RAI responses, the staff will review and incorporate the responses into its safety review. The timeliness of your responses is necessary to maintain the schedule, and any delay could result in additional revisions to the enclosed schedule with the potential of leaving milestone schedule dates to be determined (TBD) until responses are received and appropriately factored into a new schedule. Any additional RAts that the staff requires beyond the date of this letter will be considered open items for the safety review. We request that you inform the NRC staff as early as possible should potential delays arise in your support of this schedule.

B.Allen - 2 We would like to emphasize that the NRC staff will make every effort to meet the revised schedule milestones. The NRC will continue to follow established review procedures and the enclosed schedule to complete the reviews required by 10 CFR Parts 54 and 51.
