Dear Mr. Kohn:

This is in response to your undated letier in which you requested, pursuant to the Freedom of Information Act (F0IA), documentation regarding an incident that occurred at the General Electric plant in Wilmington, North Carolina, on January 22, 1986.

The enclosed Appendix A identifies documents which are being placed in tne NRC's Public Document Room (PDR), 1717 H Street, NW, Washington, DC 20555, where they will be available for public inspection at no charge or reproduction at a nominal charge of five ($0.05) per page, as specified in 10 CFR 9.14. The documents will be filed in PDR folder F01A-86-169 under your name. We are enclosing a notice that provides charges and procedures for obtaining records from the PDR.

The enclosed Appendix B identifies draft inspection reports containing information which constitutes advice, opinions, and recommendations of the staff. This information is being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. J. Nelson Grace, Regional Administrator, Region II.

This denial may be appealed to the Commission's Executive Director for' Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
