~~Allthevalvesarelocatedinpotentiallyhighradiationareas.Theyrequiredismantlingofdischargepipingtoperformthetest,sincetherearenomaintenancevalvestoprovideatestboundary.ThereliefvalveswerepurposelydesignedwithoutsurroundingblockvalvestocomplywiththeguidanceofSubsectionNC7000oftheASMECode,SectionIII.Thus,preparationsandperformanceforTypeCtestingofthesevalvescouldresultinexcessiveradiationexposuretoplantpersonnel.ThisiscontrarytoALARApoliciesconsideringthatthevalvescanbeincludedintheTypeAtest.InadditiontoALARAconcerns,otherconsiderationssupporttheexemptionofthese'valvesfromTypeCtestrequirements.Allthevalveslocatedinthesecondarycontainment(13outof16valves)dischargeintocommonheaderswhichpenetratetheprimarycontainmentwallandthenturndownintothesuppressionpool.Toprovideatestboundaryforindividualvalveswouldrequireblankflangesineachvalvedischargeline.Theseflangeconnectionswouldthemselvesrepresentadditionalleakagepathsfromtheprimarycontainment.Also,theseflangeconnectionswouldrequireType8testing,therebyaggravatingtheALARAconcerns.ItshouldalsobenotedthatLOCApressureandvalvespringpressuretendtoseatthevalvesagainstleakage.Forthethreevalveslocatedinsidethedrywell,i.e.,CCP*RV170,171andRHS"RV152,thereislittlelikelihoodofanyleakagetothesecondarycontainment.Theonlypaththroughthesevalvesisacrossthevalveseat.LOCApressureopposesthenormalvalveopening,andthevalvesprings,setforreliefpressuresof100psigto1575psig,assistinseatingthevalves.Furthermore,anyleakagethatmightoccurwouldbedetectedduringnormalsystemoperation.SystemoperatingpressuresarehigherthanLOCApressureandtendtoopenthevalves.Thus,anyvalveseatdegradationwouldbeevidentduringsystemoperationpriortoreachingaconditionthatwouldpermitsignificantpost-LOCAleakage.Leakagethroughthesevalveswouldbedetectedearlybyseveralmeans,e.g.,lossofexpansiontanklevel(CCP),alossofreactorlevel(RHS),andanincreaseindrywellfloordraintanklevel.Basedontheaboveconsiderations,exclusionofthesafetyreliefvalvesfromtheTypeCtestingwouldpresentnounduerisktothepublichealthandsafety.

SpeciCircumstancesarePresentWhichWarrantIssuanceoftheRevestedExemtionsSpecialcircumstancesarepresentwhichwarrantissuanceoftherequestedexemption.Thesespecialcircumstancesarediscussedinaccordancewiththeclassificationcontainedintherule.(i)"ApplicationoftheregulationintheparticularcircumstancesconflictswithotherrulesorrequirementsoftheCommission;or"Aspreviouslydiscussed,AppendixJisinconflictwithALARAconsiderations.Thus,specialcircumstancesarepresentwhichwarrantgranti,ng.theexemption...(ii)"Applicationoftheregulationintheparticularcircumstanceswouldnotservetheunderlyingpurposeoftherule..."Aspreviouslydiscussed,toprovideatestboundaryforcertainindividualvalveswouldrequireblankflangesineachvalvedischargeline.Theseflangeconnectionswouldthemselvesrepresentadditionalleakagepathsfromtheprimarycontainment.Thus,specialcircumstancesarepresentwhichwarrantgrantingtheexemption.(ii)"Applicationoftheregulationi'ntheparticularcircumstances...isnotnecessarytoachievetheunderlyingpurposeoftherule;orTheunderlyingpurposeoftheruleistoassurealowleakagecontainmentwiththeultimateobjectiveofkeepingaccidentdoseslow.ThesevalvesareallincludedintheTypeAprimarycontainmentintegratedleaktest.Thedischargepipingofthevalvesisexposedtoeitherdrywellorwetwellpressureduringthetest.Thus,specialcircumstancesarepresentwhichwarrantgrantingtheexemptions.
