Dear Mr. Russell:

On behalf of Niagara Mohawk Power Corporation, I am pleased to submit our Restart Readiness Report (Report) which demonstrates that Nine Mile Point Unit 1 can be safely restarted and operated, subject to the completion of the items clearly identified therein. The Report is submitted in fulfillment of Niagara Mohawk's third action required by Confirmatory Action Letter 88-17 dated July 24, 1988.

The Report represents a comprehensive evaluation of the effectiveness of the corrective actions contained in the Restart Action Plan which was originally submitted to you on December 20, 1988. Over six thousand manhours were spent in preparing this Report and in assessing our nuclear program through audits, field observations, performance reviews, and personal interviews.

The Report was prepared by the Restart Review Panel consisting of technical and management experts from both within and outside the Company chaired by Mr. Lawrence Burkhardt, III, Executive Vice President-Nuclear Operations. A letter dated September 7, 1989 transmitting the Report to me and discussing elements of the Panel's review is attached to the Report. The Panel's Report has been presented to the Board of Oversight Committee, Mr. Endries, President of Niagara Directors'uclear Mohawk, and me. Based upon a careful review of the Report, supported by continuing discussion and personal observation, I am satisfied as to the scope and depth of the assessment, and I am in accord with its conclusions.

Mr. William T. Russell Page 2 September 8, 1989 The Report reflects a number of open items which must be closed prior to restart. Each has been examined to assure that it does not detract, from the ability of the Company to make a present decision regarding restart. We are making every effort to close each item rapidly although some, by their nature, can only be closed over the ensuing weeks leading to restart. A complete list of these items is being tracked and is available for review by the NRC.

As noted in the Report, upon the completion of the remaining items for restart delineated in the Report, I will again communicate with you requesting your approval for restart.
