Dear Messrs. Kutikkad and Meyer:

I am responding to your letter, dated August 29,1997, in which you sequested approval to use the Department of Energy's (DOE's) TRANSCOM satellite based vehicle tracking system to monitor an upcoming spent fuel shipment from youi facility to DOE's Savannah River Plant.

This shipment will cross Tennessee, and we understand that your request was prompted by Tennessee's desire that the shipment be monitored on the TRANSCOM system.

NRC has no requirement for the use of such tracking systems. We do not object to your voluntary use of TRANSCOM. Ilowever, as an NRC licensee, you are responsible for assuring that your use of TRANSCOM complies with 10 CFR Part 73, including the requirements regarding the protection of Safeguards information [10 CFR 73.21, and 73,37(f)]. Note that these requirements also limit the distribution of spent fuel shipment itineraries to the Governors (or designees) of states through which the shipment will travel. All recipients of Safeguards Information are obliged to protect that information from disclosure until 10 days after the shipment arrives at its destination.
