Gentlemen:
This refers to the routine safety inspection conducted by Messrs. A. Dunlop
and M. Kunowski'of this office, Mr. M. Mendonca of the NRC Office of Nuclear
Reactor Regulation _ and Ms. C. G. Jones of the Office of Nuclear Material-
Safety and Safeguards from August 15 through October 1, 1990, of activities
at Missouri University Research Reactor, authorized by NRC Operating License
No. R-103 and to the discussion of our findings with you at the conclusion of
the.onsite inspection. A subsequent telephone exit was conducted on
October 1, 1990, with C. McKibben of your staff.
.The enclosed copy of our inspection report identifies areas examined during
the inspection. Within these areas, the inspection consisted of a selective
examination of procedures and representative records, observations, and-
interviews with personnel.
-During this inspection, certain of your activities appeared to be in violation
of NRC requirements, as specified in the enclosed Notice.
Our concerns in these
matters are: (1) the failure to adhere to the package dose _ rate limits'for,a
~
non-exclusive use shipment of radioactive material, and (2) the failure
to survey the bottom of the package, as required. These-issues carried-the
potential for higher than expected exposures to freight handlers or other-
members of the public coming.into contact with the package.
Violation No. 1
as described in the enclosed Notice of Violation, has been categorized as a
Severity Level:IV. violation.
Violation No. 2 would normally be categorized
.
-as a Severity Level III-violation _in accordance with Supplement V of the " General
Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy),
10 CFR Part 2, Appendix C (1990).
However, the' package remained relatively
. inaccessible and did not constitute a major health or safety concern because
you provided written instructions to the truck driver to proceed directly to _
the destination and took action to prevent the opening of the transport vehicle-

between-your facility and the consignee. Therefore, after consultation with
the Director, Office of Enforcement, this violation has been classified as
It is expected that you will ensure that future radioactive
material shipments meet the radiation level criteria appropriate for the
transport method used.
