Docket No. 50186 University of Missouri Research Reactor IJeense R 103 SUIMECT: Reply to a Notice of Violation in accordance with 10CFR2.201 This is a written statement required by 10CFR2.201 in response to the February 2,1998, Notice et Violation INRC Inspection Report No. 50186/98201 (DRPM)] cencerning events at the University of Missouri Research Reactor (MURR).

During an NRC inspection conducted January 1216,1998, a Severity Level IV violation was identified requiring a written response. The' violation 150186/9820101)is quoted below followed by our response, wh!ch includes specific corrective actions taken.

Title 10 to the Code of Federal Regulations Section 50.54(11) states that "Within three months after issuance of an operating licent.e, the licensee shall have in effect an operator ret.ualification program which must as a minimum, meet the requirements of 555.59 of this chapter. Notwithstanding the provisions o 550.59, the licensee n,ay not, except as r

specifically au'horized by the Commission decrease the scope of an approved operator requalificatio.. program." The licensee's Licensed Operator Requalification Program, Section 2.4," Annual Operating Test and Evaluation," required that each licensed operater be administered an ann 9al operating test. Individuals authorized to conduct the test included the Training Cooruinator, Reactor Manager, Reactor Operations Engineer, and Shif1 Supervisors.

Contrary to the above, the 1997 annual operating tests administered to the Reactor Operations Engineer, all four Shift Supervisors, the Training Coordinator, and one senior reactor operator wore conducted either in part or entirely by persons other than those individuals authorized.

1. Reason for Violation The MURR Requalification Program delegates the administration of the operating tests from the Reactor Manager to the Operations Engineer, Training Coordinator and Shift Supervisors. Senior reactor operators can and do fill the roll of Shif1 Supervisor and nave the knowledge to administer the operatmg tests. MURR management had interpreted the Fequalification Program definition of Shill Superdsor as any senior reactor operator who can act as a shif1 supervisor. Therefore, the senior reactor operators were allowed to administer the operating tests Review of the console logs showed that none of the Senior Reactor Operators were acting as Shif1 Supervisor when they administered the operating tests.

2. Co-rective Steps Taken and Results Achieved By January 31,1998, the Operations Engineer reviewed the 1997 operating tests and had re.

administered the specific sections of the operating tests to the four Shift Supervisors. Also, the Shift Supervisors,in turn, administered the specific sections of the operating tests to the senior reactor operators and reactor operator, including the Training Coordinator All licensed personnel have completed their 1997 operating test sections in accordance with the MURR Requalification Program.

On February 13,1998, the Acting Reactor Manager issued a memo to alllicensed operators stating that only the Reactor Manager, Operationa Engineer, Training Coordinator or Shift Supervisors can administer the rt qualification test.

3. Corrective Steps to Avoid Further Violatinus The review of this violation and the corrective action already taken have reinforced the proper interpretation of the MURR Requallikation Pragram. No additional corrective steps are required.
4. Date When Full Compilance Will Be Achieved The 1997 operating tests for all control room staff and licensed management staff are now in compliance. The 1998 operating tests are being completed in full compliance with our Requalification Program by having the operating tests administered by authorized individuals.
