SUBJECT:
ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR HAVING ENGAGED IN PROTECTED ACTIVITIES
Dear Dr. Wallace:
On October 31, 1996, the NRC Office of Investigations (01) issued its investigation report regarding alleged discrimination by the University of Missouri management against senior research laboratory scientists who raised safety concerns (protected activities). The report also documented investigation results regarding allegations that university management provided false information to the NRC.
The investigation concluded that, based on the evidence, the allegations could not be substantiated. A copy of the 01 Report Synopsis is enclosed.
In addition, inspections conducted by this office in June 1995 and November 1996 made independent evaluations of corrective actions you described during an enforcement conference conducted on July 22, 1994, and in your October 28, 1994, response to the September 12, 1994, Notice of Violation.
The inspection findings determined that your corrective actions appeared adequate to ensure employee safety concerns (protected activities) are handled appropriately and that employees feel free to express these concerns openly without fear of retaliation. The violations (EA 94-121/01012 and 02012) cited in the September 12, 1994, Notice of Violation, are closed.
Based on the results of 01's investigation and based on our review of your corrective actions, we have determined that no further enforcement action is appropriate at this time.

j SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Connission (NRC), Office of Investigations (0I), Region III (RIII), on March 6,1995, to determine whether a senior research scientist at the Missouri University Research Reactor (HURR) was the victim of discrimination for identifying safety concerns.
In.'ddition, the following allegations were received by l
OI:RIII during the ca;e of the investigation: that allegedly senior

University of Missouri - Columbia (UMC) officials continued to discriminate against two senior research scientists at the MURR, following a finding by the Department of Labor (DOL) that the two scientists had been discriminated against by the Director of MURR for raising safety concerns: that senior UMC 4
officials allegedly made material false statement to the NRC at a July 22, 1994, enforcement conference by NRC:RIII and in response to a September 12, 1994, Demand for Information (DFI): and alleged discrimination against a i
research scientist at the MURR for raising safety concerns regarding the l
TRUMP-S project.
I Based on the evidence developed during the investigation, it is concluded that the allegations of discrimination by senior UMC officials and the alleged material false statements to the NRC by these same officials were not l
