Dear Mr. Buggs:

This letter is in reply to your July 9,1989 lettar to Chairman Carr of the U.S. Nuclear Regulatory Commission -(NRC).

As discussed in our letters of April 14,.1989 June 15, 1989, and July 3, 1989, the concerns you identified have some technical merits. However, these concerns do not constitute nuclear safety issues. Nevertheless, as described in our previous letters, the NRC has reviewed TVA's efforts related to these concerns.

These efforts include system tests to determine whether or not modifications are warranted. TVA's final resolution of these issues will be reviewed by the NRC staff.

With respect to your access to TVA documents TVA's decision is wholly within their purview. Absent additional information, the NRC staff finds that TVA's actions to address these issues are acceptable. If you have additional information or questions, please contact Paul Cortland (301) 492-0754.

You stated that you are skeptical of the corrective actions being implemented at the Browns Ferry Nuclear Plant in response to the concerns you raised while still an employee of the Tennessee Valley Authority (TVA). Further, you stated that TVA wil,1 not allow you to examine these corrective actions, and you requested that the NRC examine the Condition Adverse to Quality Reports which documented your concerns, as well as the associated proposed corrective actions, to determine i TVA has resolved the concerns.
