SAFETY EVALUATION OF RELIEF REQUEST PV-38 FOR THE INSERVICE TESTING, VALVE PROGRAM - BROWNS FERRY NUCLEAR PLANT UNITS 1,2, AND 3 (TAC NOS. MA4577, MA4579 AND MA4581

Dear Mr. Scalice:

~ By letter dated January 8,1999, Tennessee Valley Authority submitted Relief Request PV-38, from the requirements of the'American Society of Mechanical Engineers (ASME) Boiler and Pressure Vessel Code (Code)Section XI Inservice Testing, Valve Program for the Browns Feny Nuclear Plant (BFN) Units 1,2 and 3. The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the proposed relief request against the requirements of the 1989 Edition of Section XI of the ASME Code pursuant to Section 50.55a of Part 50 to Title 10 of the Code of Federal Reaulations (10 CFR).

1 Based on its review, the NRC staff has determined that the ASME Code requirements would result in hardship'or unusual difficulty without a compensating increase in the level of quality and safety. Therefore, the proposed attemative to the ASME Code requirements is authorized pursuant to 10 CFR 50.55a(a)(3)(ii). The relief is authorized by law, will not endanger life, i

property, or the common defense and security, and is otherwise in the public interest, giving due consideration to the burden upon the licensee that could result if the requirements were imposed. Our safety evaluation is enclosed.
