Enclosed, for the consideration of the Licensing Board, are copies of a

" Joint Motion To Approve Stipulation," " Joint Stipulation Regarding Settlement of ECNP Proposed Contentions," and a proposed " Order Granting Joint Motion To Approve Stipulation."

The precise terms of the enclosed Stipulation reflect more than a year of detailed settlement negotiations among the NRC staff, Licensee, and the sole remaining petitioner for intervention in this proceeding, ECNP. Because the enclosed Stipulation resolves all of ECNP's remaining proposed contentions, the Joint Motion requests both the dismissal of ECNP as a petitioner in the proceeding and the dismissal of the proceeding itself.

The participation and cooperation of ECNP's representative, Dr. Judith Johnsrud, in the settlement discussions is appreciated.
