(+ MINUTES OF CONFERENCE CALL OF OCTOBER 14, 1988 On October 14, 1988 a conference call was held among the Atomic Safety and Licensing Board and parties to this proceeding. Participating in the call

! were: Thomas Baxter, counsel for the Licensee, Stephen Lewis, counsel for the NRC staff, Frances Skolnick, representative of the Joint Intervenors (JI),

3 and Judges Bloch and Paris.

The principal purpose of the call was for the parties to advise the Board of an agreement that had been reached among the parties as to the scheduling of witnesses for the hearing and for the parties to advise the Board of their respective positions on "SVA/TMIA'S Motion to Submit Witness's Testimony as Evidence Without Cross-Examination, at Hearings in Lancaster," dated October 4, 1988. The following schedule and order for presentation of witnesses was accepted by the Board:

Week of October 31, 1988.

JI witness Richard Piccioni; Joint testimony of Licensee witnesses Kerry L. Harner and Kenneth J. Hofstetter; Licensee witnesses David R. Buchanan, James E. Tarpinian, and William W. Weaver (three separate pieces of testimony presented as a panel);

Joint testimony of Licensee witnesses Gary G. Baker and William J. Cooper; Joint testinony of Staff witnesses Lee Thonus and Michael Masnik; Testimony of Staff witness Linda F. Munson; and Joint testimony of Staff witnesses James A. Hartin, Jr. and Shlomo Yaniv.

Week of November 7,1988 Joint testimony of Licensee witnesses John A. Auxier and Jacob I. Fabrikant.

hovember 14-15, 1988 Testimony of JI witness X. Z. Morgan.

The Licensee and the Staff advised the Board that they were willing to forgo cross-examination of JI's proposed witness Charles W. Huver, who was the subject of JI's October 4 motion, only on the conditions that JI be prohibited from filing any rebuttal testimony by Dr. Huver and that the Licensee and 4

4 Staff be permitted to file rebuttal to Dr. Huver's testimony. The schedule already provides for the filing of rebuttal testimony by October 24, 1988.

Ms. Skolnick agreed to these conditions on behalf of JI. The Board indicated that if it had any questions for Dr. Huver, they would be submitted in writing to Ms.'Skolnick.

The following additional matters were discussed and clarified during the conference call:

The Board advised JI that time permitting, limited appearances would be accepted at the special evening session scheduled for November 3rd from persons who had not filed written statements with the P,oard prior to October 28, 1988.

The Board stated that if it had any questions for the parties arising from matters raised in limited appearance statements, it would provide the parties with sufficient time to prepare responses for the record. '

The Staff clarified that the documents enclosed with its testimony on October lith, were references cited in the testimony of Dr. Yaniv and Fr. Martin and that the Staff did not intend to introduce those documents as evidence at the hearing. The Staff further stated that it would offer into evidence Supplement No. 2 to the PEIS. The Staff noted that it was unclear whether JI intended to seek introduction into evidence of any of the attachn:ents to the testimony of Dr. Morgan. Ms. Skolnick stated that she would discuss the matter with Dr. Morgan and would promptly advise the parties and the Board as to JI's intentions.
