Enclosed for your approval is a stipulation agreed to by the Staff, Licensee and Intervenor William Lochstet pursuant to which Dr. Lochstet will withdraw from this proceeding. Also enclosed are (1) a Joint Motion to Approve the Stipulation, (2) a Proposed Order granting our Joint Motion and (3) the Amendment of Order and Safety Evaluation which the Director, Office of Nuclear Reactor Regulation will issue upon the granting of the Joint Motion.
This stipulation and motion do not affect the proposed contentions of Intervenor Environmental Coalition on Nuclear Power. The Staff intends to continue to discuss settlement of those contentions with ECNP.
