Administrative Law Judge Atomic Safety and Licensing Board Panel U.S. Nuclear Regulatory Commission Washington, D.C. 20555 In the Matter of GPU NUCLEAR CORPORATION (Three Mile Island Nuclear Station, Unit No. 2)

Docket No. 50-320 (Civil Penalty)

License No. DPR EA 84-137

Dear Judge Smith:

I am writing to memorialize the conference call among the parties and yourself yesterday morning concerning the schedule for filing objections to discovery, and for completing discovery in this case.

Both the NRC staff and GPU Nuclear will serve their current objections on or before February 2, 1987, by hand. The time for responses will be as set forth in the Commission's Rules of Practice. GPU Nuclear's objections involve cicims of privilege on documents identified by the Staff. GPU Nuclear will also be addressing its desire to depose Ronald A. Meeks, an investigator with the Commission's Office of Investigations, and David Feinberg, a former De-partment of Labor CompUance Ofncer.

The Staff intends to serve its objections to GPU Nuclear's asserHon of privi-lege with respect to materials gathered in an investigation by Bechtel North American Power Corporation into allegations made by Richard Parks.

As a result of plans by the parties to conduct depositions of numerous pm-spective witnesses during the months of February, March and April of this year, the parties requested, and you granted, an additional 90 days in which to complete discovery. As a result, discovery is to be completed by May 1, 1987.
