ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Dotht t. 50-413 Catawba 1 l*;erse No. NPF-35 During the Nuclear Regulatory Commission (NRC) inspection conducted on November 26, 1987 - December 25, 1987, a ,iolation of NRC requirements was identified. In accordance with the "General Statement of Policy and P:ocedure for NRC Enforcement Actions",10 CFR Part 2, Appendix C (1987), the violation is listed below:

Technical Specification 4.8.1.1.3 requires that all diesel generator failures, valid or non-valid, be reported in a Special Report to the Commission pursuant w Specification 6.9.2 within 30 days.

Technical Specification 6.8.1 requires that written procedures shall be established, implemented, and maintained covering the applicable procedures recommended in Aopendix A to Regulatory Guide 1.33, Revision 2.

Operations Management Procedure 2-28, Revision 11, Diesel Generator Logbook, section 3.3 requires that each diesel generator start attempt be classified as either a Valid Success, Valid Failure, Invalid Test or Invalid Failure.

Contrary to the above, on November 13, 1987, the licensee failed to properly classify start attempt number 548 on Diesel Generator 1A as an Invalid Failure and therefore failed to report the . event to the Ccmmission in a Special Report within 30 days.

This is a Severity Level IV Violation (Supplement I). -

Pursuant to the provisions of 10 CFR 2.201, Duke Power Company is hereby required to submit a 'ritten statement or explanation to the Nuclear Regulatory Commission, ATTN. Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to tha NRC Resident Inspector within thirty (30) days of the date oi the letter transmitting this Notice. l This reply should be c'early marked as a "Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which ,

have been taken and the results achieved, (4) the ccreective steps which w'll  ;

be taken to avoid further violations, and (5) the date when full compliance I will be achieved. Where good cause is sheer consideration will a giver, '
