Alabama Power Company submits the following in response to the items listed in Appendix A of the Notice of Violation which resulted from the inspection conducted by Mr. W. H. Miller at Farley Nuclear Plant on August 16-19, 1983 (Report Nos. 50-348/83-21 and 50-364/83-19).
NRC Violation A. Technical Specification Section 6.8.1.f requires written procedures to be established, implemented and maintained covering the fire protection program implementation.
Contrary to the above, procedures had not been established to implement the following portions of the fire protection program:
- 1. Surveillance inspection and test of the fire detection instruments for Unit 1 Communication Room 202, Switchgear Room 335 and Switchgear Room 343 as required by Technical Specification Section 4.3.3.9.1;
- 2. Surveillance valve cycle test of a number of fire protection E system control and sectional valves as required by Technical Specification Setion 4.7.11.1.1.e and 4.7.11.2.b; and,
- 3. Surveillance inspection and test of the carbon dioxide system hose reel units located in the auxiliary building as required by Technical Specification Section 4.7.11.3.2.b.

Alabama Power Company acknowledges the violation as stated above and concedes a procedural deficiency existed regarding the Farley Nuclear Plant Procedures in administering the cited sections of the Technical Specifications. Corrective action for each item is:
- 1. Alabama Power Company revised the Farley Nuclear Plant Procedure (FNP-1-STP-131.02) on August 18, 1983 to include the Technical Specification requirement (Section 4.3.3.9.1) for !
surveillance inspection and test of the fire detection
( instruments for Unit 1 Rooms 202, 335 and 343,
- 2. Alabama Power Company revised the Farley Nuclear Plant Procedure (FNP-0-STP-56.0) on September 2,1983 to include the Technical Specification requirements (Section 4.7.11.1.1.e and
' 4.7.11.2.b) for surveillance valve cycle test of fire protection system control and sectional valves.
- 3. Alabama Power Company will revise the appropriate Farley Nuclear Plant Procedures by January 1,1984 to include the Technical Specification requirement (Section 4.7.11.3.2.b) for surveillance inspection and test of the carbon dioxide system hose reel units located in the auxiliary building.
NRC Violation B. License Condition paragraph 2.c.(9) requires the licensee to maintain in effect and fully implement all provisions of the approved fire protection plan entitled "Farley Nuclear Plant Fire Protection Program Reevaluation" dated September 15, 1977 through Amendment 4 dated January 3,1979. Section 4.4.4.3.5 of this reevaluation report states that vertical cable tray runs of more thar. 20 feet with no penetration seal will be provided with fire breaks consisting of a Marinite board sealed with a flame retardant coating.
Contrary to the above, vertical cable tray runs of over 20 feet are located in the Unit 2 auxiliary building and are not provided with fire breaks.
The violation is applicable only to Unit 2.
APCo Response B. Alabama Power Company acknowledges the violation as stated above.
The Marinite fire breaks were deleted as a requirement in Unit 2 by a change notice (CN) dated November 20, 1980. The CN resulted from an engineering analysis of these fire breaks which concluded that such stops were not needed since credit was not taken for them in

! the Fire Hazard Analysis of the Fire Protection Program Reevaluation (FPPR) or any other Unit 2 fire protection analysis.
Amendment 5 to the FPPR also deleted Section 4.4.4.3.5 of Amendment 4 which required these fire breaks. Marinite or equivalent material fire breaks will be installed as required throughout Unit 2 by the end of the 3rd Unit 2 outage presently scheduled to begin in January 1985.
Based on conversations between the NRC Staff and Alabama Power Company held subsequent to the identification of the above )
violation with respect to fire breaks on vertical cable tray runs, ;
Alabama Power Company conducted an exhaustive review of the Farley I fire protection program. As a result of this review Alabama Power Company has:
- 1. Issued a management directive with written instructions that re-emphasizes that the FPPR shall be considered on the same basis as the Farley Final Safety Analysis Report (FSAR).
Instructions to the designers have been issued to ensure that future design changes involving fire protection will not decrease the effectiveness of the program as defined by Amendment 5 to the FPPR subject to the clarifications contained in Attachment I to this letter (discussed in more detail in item 3 below). t t

since the fuel load licensing dates of June 25,1977 (Unit 1) and October 23,1980 (Unit 2) and determined that the deletion l
of the marinite fire breaks was the only identified devietion j f rom the approved design criteria in Amendment 4 which could
- have decreased the effectiveness of the FPPR as defined in Amendment 4. The corrective action for this item was discussed
[ in the above violation.
- 3. Conducted an exhaustive comparison of FPPR Amendment 5 to Amendment 4. Amendment 4 is the last amendment referenced in the Farley Nuclear Plant operating licenses. Based on a review l
of this comparison, Alabama Power Company concluded that no change decreases the effectiveness of the Farley Fire Protection System as currently defined except the deletion of 1 the marinite fire breaks. The remaining differences between i
the amendments were divided into two groups. The first group of differences consists of 30 items identified as changes to
- the fire protection program which did not decrease the effectiveness of the program. These changes were brought about by refinements in the program as detailed engineering review and analysis was completed. Attachment I describes these l changes. The second group of differences are not considered to be changes to the fire protection program but were only made in

. a) correct omissions and errors in the earlier revisions b) reflect the as-built status of both units c) clarify program requirements and comitments by issuing a more readable and useable document d) reflect the completion of certain commitments.
These administrative and editorial changes are desciibed in Attachment II.
The changes shown in Attachments I and II are consistent with Amendment 11 to the Farley Nuclear Plant Unit 1 Operating License which states that " Alabama Power Company is authorized to make other changes to the program without prior Comission approval provided that such changes do not result in a decrease in the effectiveness of the program".
Based on the comparisons and reviews outlined above and subject to the clarifications discussed in Attachment I, Alabama Power Company has concluded that Amendment 5 of the FPPR constitutes the current fire protection program at Farley Nuclear Plant and intends to use it as the controlling document for the program. Consistent with the requirements of Amendment 11 to the Farley Nuclear Plant Unit 1 Operating License, Alabama Power Company will continue to obtain Comission approval prior to implementing any program changes which could result in a decrease in program effectiveness. Any changes which in the judgement of Alabama Power Company do not decrease the effectiveness of the program will be documented and included in the next amendment to the FPPR. Future amendments to the FPPR will be sent to the NRC.

Fim Area Fim Area Amendnent #4 proposed a minimum half-hour 1-1 (2-1) 4-144 1-1 (2-1) fire rated blanket installed over the 1-4 (2-4) 4-155 1-4 (2-4) 4-210 self-expanding cork for the portions of the 1-5(2-5) 4-156 1-5 (2-5) 4-214 area boundary along the containment wall 1-34 (2-34) 4-223 1-34 (2-34) 4-252 which are also boundaries of other fire 1-35 (2-35) 4-225 1-35 (2-35) 4-254 areas for each of the listed fire areas.
Amendnent #5 should have deleted all of these proposals since prior conversations with the NRC had detennined that the elimination would not degrade the fire protection system. Even though the proposals were inadvertently left in Amendnent #5, they are not considered a part of the fire protection system.

- 6. Fire Area Fire Area Amendnent #4 proposed a sprinkler system for 1-5 (2-5) 4-23 & 4-157 1-5 (2-5) 4-2 & 4-214 Room 172 and 174 while the SER only mquires sprinkler coverage in Room 172. A fire originating in Roan 174 would be contained within the room because of the quantity of conibustible material and the barriers. Also the room contains only the hot shutdown cable associated with the pump in the room.
Sprinkler coverage requirement has been eliminated for Room 174 in Amendnent #5 and coverage is not provided.

Independence from either cable chase is not required for hot shutdown and goes beyond the Amendaent #4 connitment. If a fire were to destroy any cable chase, the plant could be brought to hot shutdown from the control room. Thus, independence of the instnrentation from the cable chase is not re@imd.
