RE: SOUTH TEXAS NUCLEAR PROJECT, UNITS 1 AND 2 This letter acknowledges receipt of a Petition dated March 17, 1988, filed pursuant to 10 CFR $2.200 by you, the addressees, on behalf of the organizations ycu represent. You requested that the Commission delay voting on a full power operating license for the South Texas Nuclear Project (STNP) until NPC completes an investigation of all allegations regarding the STHP and releases to the public a report disposing of each allegation. You assert as the bases for this request that (1) many allegations are not yet resolved and are to be the subject of future reports or future corrective action; (2) no decision on the safety of the plant or on the corporate character and competence of Houston Lighting & Power Company (HL&P) can be made until the allegations of harassment and intimidation and wrongdoing are resolved; (3) the Safety Significance Assessment Team (SSAT) review of the allegations relied on a sampling of items; (4) some items, such as the essential cooling water system, are expressly left unresolced by the SSAT Report (NUREG-1306); and (5) the NRC should require HL&P to 7tove the plant safe, rather than requiring the public to prove the plant unsafe.
Your requests have been considered pursuant to 10 CFR $2.206 and the enclosed "Director's Decision Under 10 CFR 62.706" provides a full response. For reasons stated in the Decision, your requests to celay licensing actions on the South Texas Nuclear Project are denied.
