o APPENDIX A Rockwell Engineering Company Docket No. 99900836/87-01 NOTICE OF VIOLATION As a result of the inspection conducted on February 19, 1987, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulation 10 CFR Part 21, the following violations were identified and categorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 49 FR 8583 (March 8, 1984):

A. Section 21.21 of 10 CFR Part 21, states, in part, "Each... corporation....

subject to the regulations in this part shall adopt appropriate procedures ,

to: (1) provide for: (1) evaluating deviations...."

Contrary to the above, at the time of the inspection, Rockwell Engineering (RE) failed to adopt a Part 21 procedure for evaluating and reporting deviations. Part 21 was imposed on the RE by the-VEPC0 P0 ET-16183 for ASTM A36 W10X49 wideflange members for the new service water spray array system supports. (87-01-01)

This is a Severity Level V violation (Supplement VII).

B. Section 21.31 of 10 CFR Part 21 states, in part, "Each... corporation....

subject to the regulations in this part shall assure that each procure-ment document for a basic component issued by...it on or after January 6,1978 specifies...that the provisions of 10 CFR Part 21 apply."

Contrary to the above, RE failed to pass down the requirements of Part 21 to subtier vendors Empire Galvanizing, Weld Star, and Central Steel and Wire responsible for providing materials and services in fulfilling P0-ET 16183 from VEPC0 for the new service water spray array system supports.

This is a Severity Level V violation (Supplement VII). l C. Section 21.6 of 10 CFR Part 21 states, in part, "(a) Each... corporation....

shall post current copies of the following documents in a conspicous position...where the activities subject to this part are conducted...(2) i Section 206 of the Energy Reorganization Act of 1974 and (3) procedures  !

adopted pursuant to the regulations in this part...."

Contrary to the above, RE failed to post copies of Section 206 or a procedure for evaluating and reporting deviations pursuant to.Part 21.
