Fisher Controls International, Inc.
Docket No. 99900105/86-01 NOTICE OF VIOLATION As a result of the inspection conducted on October 7-10, 1986, and in accordance with Section 206 of the Energy Reorganization Act of 1974 and its implementing regulation 10 CFR Part 21, the following violations were identified and categorized in accordance with the NRC Enforcement Policy (10 CFR Part 2, Appendix C), 49 FR 8583 (March 8, 1984):
A. Section 21.21 of 10 CFR Part 21, dated January 1, 1986, states, in part:
"Each individual, corporation, partnership or other entity subject to the regulations in this part shall adopt appropriate procedures to provide for evaluating deviations or informing the licensee in order that the licensee may cause the deviation to be evaluated...."
Contrary to the above, Fisher Controls International, Inc. (FCI) does not have a procedure to provide for evaluating deviations in parts, components, or products which are intended for nuclear use and are processed under the Standard Quality Assurance Manual (SOAM). (86-01-01)
This is a Severity Level V violation (Supplement VII).
B. Section 21.31 of 10 CFR Part 21, dated January 1,1986, states: "Each individual, corporation, partnership or other entity subject to the regulations in this part shall assure that each procurement document for a facility, or basic component issued by him, her or it on or after January 6,1978 specifies, then applicable, that the provisions of 10 CFR Part 21 apply."
Contrary to the above, FCI failed to essure that procurement documents for two (2) safety-related Limitorque motor operators specified that the provisions of 10 CFR Part 21 were applicable. (86-01-07)
