1999, a violation of NRC requirements was identified. In accordance with the " General l Statements of Policy and Procedure for NRC Enforcement Actions," NUREG-1600, the violation j is described below:

VIOLATION NO. 99-202-01 l l

Title 10 of the Code of Federal Regulations (CFR), Part 74.33 (c) (7) (ii), System features and capabilities, states in part:

The licensee shall establish, document and ma.ntain a resolution program that ensures that any shipper-receiver differences (SRDs) are resolved that are statistically significant and exceed 500 grams 23sU on a total shipment basis for all source material and special nuclear material.

Contrary to the above, the certificate holder failed to establish document and maintain a program that investigates shipper-receiver 235U differences on a total shipment basis A review of DOE /NRC 741 forms for the period July 1998 through December 1998 identified eignt receipts that met the requirements for SRD 235U evaluation on a total shipment basis. No documentation was produced by the certificate holder to indicate the evaluation had occurred for these particular shipments or others on a total 23sU shipment basis.

This is a severity level IV violation (Supplement Vil).

Pursuant to the provisions of 10 CFR 76.60, USEC is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region 111, and the Branch Chief, Fuel Cycle Operations Branch, Division of Fuel Cycle Safety and Safeguards, NMSS, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This .

reply should be clearly marked as a " Reply to a Notice of Violation" and should include, for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid future violations, and (4) the date when full compliance will be achieved. . correspondence adequately addresses the required response. If an adequate reply is not l received within the time specified in the Notice, an order or Demand for information may be issued as to why the certificate should not be modified, suspended, or revoked, or why such action as may be proper should not be taken. Where good cause is shown, consideration will be given to extending the msponse time.

If you contest this enforcement action, you should also provide a copy of your response to the l l Director, Office of Enforcement, United States Nuclear Regulatory Commission, Washington, D.C. 20555-0001.
