NOTICE OF VIOLATION  ;

As a result of the./ inspection conducted on August 3-6, 1987, and in accordance .

with Section 206 cf the< Energy. Reorganization Act of 1974 and its implementing f regulation 10 CFR Part 21. the following violations were identified and categorized in accordance with the NRC Enforcement Policy (10 CFR Partt 2; Appendix C), 49 FR 8583(March 8,1984): jj

1. Section 21.6 of 10 CFR Part 21 dated October 31,1986[' states,' in part.

"(u) Each... corporation... subject to the regulations in this part, shall.

post current copies of the following documents in-a conspicuous position. .

, (1) thb regulations in this part, (2) Section 206:of the Energy.Reorganiza-tion Act, and (3) procedures adopted pursuant to, the regulations in this  !

Contrary to the above, a copy of Section 2069as not ' posted in three areas 1 where Part 21 and a procedure were. posted. (87-01-01)

This is,a Severity Level V violation (Supplement VII). l l

2. Section 21.31 of 10 CFR Part 21 dated October 31, 1986, states, in part, "Each... corporation... subject to the regulations in this part shall assure i

that each procurement ' document for a... basic component... specifies, when applicable, that the provisions of 10 CFR Part 21 apply."

Contrary to the above, a review of purchase orders (PO) to service vendors.

revealed that while 10 CFR Part 21 was imposed upon SWL, SWL did not impose 10 CFR Part 21 requirements on P0s 5150 (December 23,1986),1810 (July 21, 1987) and 1308 (November 21,1986) to Coffer Laboratories, and 5542 (March 5, 1987) to Page-Wilson and 6183 (June 11, 1987) and 440 (January 23,1985) to Gulf States Balance. (87-01-02)

This is a'$everity Level IV violation (Supplement VII).

3. Section 21.21 of 10 CFR Part 21 dated October 31, 1986', states, in part,

"(a) Each individual, corporation, partnership, or other entity subject to the regulations in this part shall adopt appropriate procedures to:

...(2) Assure that a director or responsible officer is informed if the construction or operation of a facility, or activity, or a basic component supplied for such facility or activity: ...(11) Contains a defect..,."

Contrary to the above, SWL's 10 CFR Part 21 procedure No. 9700-108-87.does not ensure that a responsible officer shall be notified in all cases when a defect is found in a safety-related basic component. (87-01-03)

This is a Severity Level V violation (Supplement VII).
