As a result of the inspection conducted on June 17, 1985, and in accordance 1

with the NRC Enforcement Policy (10 CFR 2, Appendix C), the following violations j

were identified:

1 A.

10 CFR 31.5(c)(8) requires that except as provided in 10 CFR 31.5(c)(9) transfers or disposal of devices containing byproduct material be trans-ferred only to a person holding a specific license pursuant to 10 CFR Parts 30 and 32.

Contrary to the above, licensed material was transferred from the

Surigut facility in Rochester, New Jersey to the Paper Manufacturing i

Company facility in Philadelphia, Pennsylvania, a company not specifically 1

licensed to possess this material.

This is a Severity Level IV violation (Supplement VI)

B.

10 CFR 31.5(c)(2) requires that the device be tested for leakage of radio-active material at no longer than six-month intervals.

Contrary to the above, as of June 17, 1985, a sealed source containing i

less than 75 microcuries of Promethium-147 had not been tested for leakage since its installation, i

Pursuant to the provisions of 10 CFR 2.201, Paper Manufacturing Company is j

hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in j

reply, including: (1) the corrective steps which have been taken and the re-

suits achieved; (2) corrective steps which will be taken to avoid further vi-olations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
