SUBJECT:
IMMEDIATE EFFECTIVENESS REVIEW FOR DIABLO CANYON UNIT 2 On June 27, 1985, the Appeal Board affirmed the Licensing Board's decision ff and upheld the adequacy of the design of Diablo Canyon, Unit 2.
Therefore, an Inunediate Effectiveness Review is no longer necessary. The only remaining
'(question is whether the Comission wishes to delay effectiveness pending its review of the Appeal Board's decision.
In the meantime, no further hearings are necessary and we see no technical reasons in the Appeal Board's decision which appears to warrant a stay in issuing a full power license for Diablo Canyon, Unit 2.
A final supplemental SER will be issued by the staff covering any remaining allegations. Any other issues which could have a bearing on the Comission's decision on issuing a license would be discussed with the staff and OI in their briefings before the Comission on July 30, l
1985. Unless otherwise instructed by the Comission, OPE plans no further action on this matter.
