2.206 REQUEST FROM NORTHERN CALIFORNIA POWER AGENCY FOR ENFORCEMENT OF DIABLO CANYON ANTITRUST LICENSE CONDITIONS Attached for your information is a recent " clarification" of Northern California Power Agency's (NCPA's) petition for enforcement of the Diablo Canyon antitivst license conditions. NCPA's " clarification" petition was furnished at the request of the NRC staff in an effort to have the parties focus more closely
. on those items that are still in dispute. Extensive negotiations among the parties have resolved several of the allegations raised in NCPA's initial peti.
tion of December 4, 1981. Accordingly, NCPA is now pressing only three of the nine counts for which it initially requested enforcement action. The NRC staff is therefore reconnending that you close out the remaining six counts. Enclosed for your signature is a draft letter for this purpose.

practices are resumed. The letter also advises NCPA that the remaining alle-gations are being considered by the staff and appropriate action will be taken under Section 2.206 of the Connission's rules and regulations.
