DIABLO CANYON - FINAL DECISION ON GAP PETITIONS This is to advise you that the NRR final decision regarding the 10 CFR 2.206 petitions by GAP cannot be issued at this time because our reviews and investigations of allegations in the petitions have not been completed.

(GreenTicket 000125 on this matter has response date of July 26,1985).

In the 10 CFR 2.206 petitions of November 15, 1984 and March 14, 1985 GAP requested'certain NRC actions regarding the commercial operation of Unit 1 and the licensing of Unit 2.

In our letter to GAP of May 15, 1985 (copy attached) we stated that thus far we had found no reason to take the requested actions and that our final decision would be issued upon the completion of our reviews and investigations.

Since the issuance of SSER 28 in April 1985 the reviews and investigations of allegations by NRR, Region V and 0! has continued.

Final resolution of some allegations has been reached, however none of them has been fonnally documented in a report. As stated in SSER 32 (to be issued shortly) we will issue another report documenting the final resolution. Therefore, it is recommended that no further action be taken on the GAP petitions until that report has been completed and can be issued in support of our final decision.

We do not believe that the allegations provided by GAP to 01: Region V on l
