APPENDIX A NOTICE OF DEVIAi!9N Public Service of Colorado Docket:
50-267/86-30 Fort St. Vrain Nuclear Generating Station License:
DPR-34 Based on the results of an NRC inspection conducted on October 27-31, ion 1986, one deviation from your commitment to the NRC was identified.
The deviat consisted of the failure to implement corrective action to preclude recurrence of an emergency preparedness recuirement violation.
In accordance with the
" General Statement of Policy anc Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the deviation is listed below:
Failure to Implement Action to Preclude Violation Recurrence A Notice of Violation was issued to Public Service of Colorado (PSC) on October 18, 1984, for failure to submit copies of changes to the emergency plan to the NRC in accordance with the requirements of 10 CFR 50.54(q).
In reply to this violation, PSC committed to take action to correct the failure and stated that verification of compliance with the requirement to preclude further violations would be accomplished by incorporating the verification of distribution into the quarterly surveillance test pertaining to emergency planning items.
In deviation from the above, on October 29, 1986, an NRC inspector determined that the verification of distribution committed to by PSC had not been incorporated into surveillance arocedure SR-TE-8-Q, " Maintenance of Emergency Preparedness," and was not aeing accomplished under the requirements of any other procedure (267/8630-01).
In response to this deviation, on October 30, 1986, PSC completed a Procedure Deviation Report for procedure SR-TE-8-Q, adding a requirement to the existing procedure to verify submittal of plan and procedure changes to the NRC within 30 days of the effective date of the documents.
In addition, a 3recautionary statement was added identifying this change as a commitment to tie NRC which may not be deleted without issuance of comparable controls.
A Document Coordination and Concurrence form was also initiated on October 30, 1986, to incorporate this change into the surveillance procedure.
The NRC inspector reviewed the PSC corrective action prior to the end of 'he t
inspection and found it to be responsive to the NRC concern raised in this Notice of Deviation; therefore, no additional written response is required for this deviation.
