This responds to your letter of February 9, 1983 to Mr. Trowbridge. In view of the Appeal Board's Order of February 7, 1983, Licensee has decided to attempt to make j arrangements with you to depose Licensee witnesses, once j the testimony is filed but before the hearing begins, in order to assist the development of the record. See Order at 3. It remains our view that depositions should be under-taken only where necessary to meet that goal.

t Therefore, I propose that UCS review the Licensee testimony you will receive on February 16 before we discuss arrangements for the deposition. It is my hope that after you read the testimony you may agree that one or more wit-nesses need not be deposed. Please telephone me as soon as you have had the opportunity to review the testimony, so that

{ we can attempt to agree on the arrangements.
