Dear Administrative Judges:

This letter is to advise the Board and Parties of a change in circumstances which affects the scope of discovery on Contention XX as set forth by the Board in the Prehearing Conference Order of July 26, 1982 (pages 2-3).

As described in the enclosed letter (W.F. Wegst to Hal Bernard, dated August 6, 1982), UCLA recently completed a transfer of reactor fuel sufficient to reduce the total inventory of U-235 (both irradiated and unirradiated) at the UCLA facility to less than 5 kilograms. As a result, UCLA's exemption from the requirements of 10 CFR 73.60, which incorporates certain require-ments and exemptions contained in 10 CFR 73.67, is no longer dependent on maintaining the self-protecting conditions for the l "in-core" fuel (100 rem /hr. at 3 feet, unshielded). UCLA's exemption i is now based on the fact that UCLA possesses less than 5 kilograms of reactor fuel.
